Hospice providers can continue using telehealth technology to complete required face-to-face encounters for hospice recertification through January 30, 2026. This extension became effective under Section 6208 of the Continuing Appropriations, Agriculture, Legislative Branch, Military Construction and Veterans Affairs, and Extensions Act, 2026.
As a result, hospice physicians and hospice nurse practitioners may conduct these encounters remotely for the sole purpose of recertifying hospice eligibility. In addition, this extension temporarily modifies the requirements outlined in 42 CFR 418.22(a)(4)(ii).
However, providers must use two-way audio and video telecommunications technology that enables real-time communication between the patient and the hospice physician or nurse practitioner. Therefore, encounters conducted through audio-only or video-only methods do not meet the regulatory requirements.
By extending these telehealth flexibilities, hospice organizations can continue providing timely recertification services while maintaining compliance with Medicare requirements.
